1. Overview
These Terms of Service apply to services, programmes, digital products, resources, subscriptions and other products purchased or accessed through Lizzie Fluke and the website lizziefluke.com.
Lizzie Fluke provides performance, coaching and applied services for individual athletes, teams, coaches and organisations, including athlete testing, rehabilitation services, performance programmes, coaching, applied performance resources and digital products.
Current services and products are listed through the Lizzie Fluke website and shop. These may include, without limitation:
• individual athlete services and coaching;
• team testing and performance services;
• individual testing;
• rehabilitation programmes and rehabilitation sessions;
• athlete training and performance programmes;
• digital performance products, frameworks, guides and dashboards;
• educational and applied resources;
• bespoke performance and Director-level performance work;
• access to the Lizzie Fluke Members Area.
The services available at any particular time are described on the relevant product or service page.
These Terms should be read together with the relevant product or service description and the Lizzie Fluke Privacy Policy.
By purchasing, booking, subscribing to or otherwise accessing a service or product, you agree to these Terms.
2. Registration and Purchase
To purchase or access a service, product or subscription from Lizzie Fluke, you must provide information that is accurate, current and complete.
You are responsible for ensuring that the information supplied during registration, purchase, booking, health screening or participation remains accurate and up to date.
Where a service requires health, injury, rehabilitation, medical or performance information, you must provide information that is accurate and relevant to the service being delivered.
Lizzie Fluke may decline, postpone or modify a service where the information provided indicates that the service is not appropriate to deliver safely or within the scope of the service purchased.
3. Athlete, Performance and Rehabilitation Services
3.1 Health information and suitability
Certain Lizzie Fluke services involve the collection and use of information concerning health, injury, rehabilitation status, physical capacity, training status or other performance-related information.
Health information is special category personal data under the UK GDPR where applicable and is subject to additional data-protection requirements.
Before participating in a relevant service, you may be required to complete a health questionnaire, screening form, informed-consent form or other assessment documentation.
You are responsible for providing accurate and complete information concerning relevant medical conditions, injuries, medications, restrictions, previous injuries and other circumstances that may affect participation.
3.2 Rehabilitation services
Rehabilitation services are designed around the individual information available at the time of delivery and may include assessment, exercise prescription, monitoring, progression, education and performance-related rehabilitation support.
Unless expressly stated otherwise, Lizzie Fluke services do not replace diagnosis, emergency medical care or other medical treatment.
Where appropriate, you may be advised to seek assessment, diagnosis, treatment or clearance from a suitably qualified medical professional.
You remain responsible for following medical advice provided by your doctor, consultant, physiotherapist or other healthcare professional.
Lizzie Fluke may communicate with relevant coaches, medical practitioners, physiotherapists, clubs, teams, parents/guardians or other authorised persons where this is necessary for delivery of the service and where an appropriate lawful basis, consent or other legal authority exists.
3.3 Individual and team services
Services may be delivered to individual athletes, teams, groups, clubs or organisations.
Where an organisation purchases or commissions a service on behalf of an athlete or participant, the organisation may provide relevant information required for delivery, subject to applicable data-protection requirements.
Where individual health or special category information is involved, access will be limited to what is necessary for the relevant purpose.
4. Digital Products and Resources
Digital products purchased through Lizzie Fluke are supplied for the purchaser's personal or authorised professional use as stated on the relevant product page.
Unless expressly stated otherwise, digital products, frameworks, dashboards, guides, videos, programmes and other resources remain the intellectual property of Lizzie Fluke or the relevant rights holder.
You must not:
• reproduce or redistribute purchased materials;
• sell, sublicense or commercially redistribute materials;
• upload materials to publicly accessible websites or platforms;
• share individual-access resources with unauthorised persons;
• reproduce substantial portions of the materials for commercial use without written permission.
Where a product is specifically purchased for organisational or team use, the permitted use will be determined by the relevant product description or separate agreement.
5. Members Area
5.1 Membership
The Lizzie Fluke Members Area is a paid subscription service providing access to structured learning, insight, practical tools, frameworks, dashboards, how-to guides and other resources.
The Members Area is currently offered at £13.99 per month, subject to the price displayed at the point of purchase.
Membership provides access to the content and resources made available to members during the active subscription period.
Membership does not automatically provide access to separately priced products, consultations, coaching, rehabilitation services, testing or bespoke performance work unless expressly stated.
5.2 Subscription payments
Membership fees are charged on a recurring basis according to the subscription arrangement displayed at purchase.
You are responsible for maintaining valid payment details.
If payment cannot be processed, access may be suspended or cancelled.
5.3 Cancellation
You may cancel your Members Area subscription in accordance with the cancellation mechanism made available through the website or relevant payment platform.
Cancellation will normally prevent future recurring charges while allowing access to continue until the end of the applicable paid subscription period, unless the relevant platform or product terms state otherwise.
Nothing in this section affects any statutory cancellation or consumer rights that apply to you.
6. Bookings, Cancellations and Refunds
6.1 General
The cancellation and refund terms applicable to a service or product will be those stated on the relevant product page at the time of purchase, together with these Terms.
Where no specific cancellation period is stated, reasonable notice should be provided.
6.2 Individual sessions
For scheduled individual sessions, including coaching, performance or rehabilitation sessions, 24 hours' notice is normally required for cancellation or rearrangement.
Where less than 24 hours' notice is provided, or where a participant does not attend, the session may be treated as cancelled within the applicable late-cancellation period and charged in accordance with the cancellation terms stated for that service, unless Lizzie Fluke determines otherwise.
6.3 Medical cancellation
Where an athlete cannot participate for medical reasons, cancellation or rearrangement may be permitted.
Where evidence is reasonably required, appropriate medical evidence may be requested.
Health information supplied for this purpose will be handled in accordance with the applicable data-protection provisions.
6.4 Workshops, team services and other scheduled services
Where a workshop, team service or other scheduled service has specific cancellation terms, those terms will be stated in the relevant booking or product information.
For bespoke or organisational work, cancellation, postponement and payment arrangements may be agreed separately in writing.
6.5 Digital products
Where digital content is supplied immediately after purchase, statutory cancellation rights may be affected where the consumer has expressly agreed to the immediate supply and acknowledged the effect this may have on the statutory cancellation right.
Where a service begins at the consumer's request before the end of an applicable cancellation period, statutory cancellation rights may also be affected in accordance with applicable consumer law.
Nothing in these Terms removes or restricts any consumer rights that cannot lawfully be excluded.
7. Pricing and Payment
Prices are displayed on the relevant Lizzie Fluke product or service page.
Prices may change from time to time, but a change will not alter the price of a product or service already purchased unless otherwise agreed or required by law.
Payment may be made through the payment methods made available on the website, which may include card payment and other supported payment services.
For bespoke organisational or Director-level work, payment arrangements may be agreed separately.
8. Consumer Rights
Where you are a consumer, nothing in these Terms is intended to exclude or restrict statutory rights that apply to you under applicable law.
Where applicable, statutory rights concerning digital content, services, cancellation, refunds, satisfactory quality, reasonable care and skill, and other consumer protections continue to apply.
Nothing in these Terms limits liability where such limitation is prohibited by law.
9. Liability and Responsibility
You participate in performance, coaching, testing and rehabilitation services based on your own circumstances and the information available to Lizzie Fluke.
You must inform Lizzie Fluke of any relevant change in health, injury status, medical advice or other circumstance that could affect participation.
Lizzie Fluke will provide services with reasonable care and skill.
Nothing in these Terms excludes or limits liability for:
• death or personal injury caused by negligence where such liability cannot lawfully be excluded;
• fraud or fraudulent misrepresentation;
• breach of statutory rights that cannot lawfully be excluded;
• any other liability that cannot lawfully be excluded or limited.
Subject to applicable law, Lizzie Fluke is not responsible for loss arising from inaccurate, incomplete or withheld information supplied by a participant or client.
10. Children and Young People
Where a service is provided to a person under 18, appropriate parental or guardian involvement and consent will be required where legally necessary.
The nature and level of consent required may depend upon the participant's age, capacity, the service being provided and the applicable law.
Where health information concerning a child or young person is collected, it will be processed in accordance with the applicable data-protection requirements.
11. Intellectual Property
All original content, written materials, frameworks, programmes, dashboards, graphics, videos, educational resources, methodologies and other materials supplied by Lizzie Fluke remain the intellectual property of Lizzie Fluke or the relevant rights holder unless otherwise stated.
Purchase or membership provides a right to use the relevant material for the purpose for which it was purchased. It does not transfer ownership of the intellectual property.
12. Website and Member Account Security
You are responsible for keeping account credentials, passwords and membership access information confidential.
You must not knowingly allow unauthorised persons to access your account or Members Area subscription.
Lizzie Fluke may suspend access where there is evidence of unauthorised access, misuse, account sharing or a security risk.
13. UK Data Protection and Privacy
13.1 Applicable UK legislation
Where UK data-protection law applies, Lizzie Fluke will process personal data in accordance with applicable UK data-protection legislation, including the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, the Data (Use and Access) Act 2025 (DUAA) and the Privacy and Electronic Communications Regulations 2003 (PECR), as amended and applicable from time to time.
The UK GDPR requires an appropriate lawful basis for processing personal data. Where special category data, including health data, is processed, an Article 6 lawful basis and an applicable Article 9 condition must also be identified.

Depending on the service or interaction, Lizzie Fluke may process:

• health, injury and rehabilitation information where relevant;

13.3 Purposes and lawful bases

13.4 Health and special category data
Health information is special category personal data under the UK GDPR.
Where Lizzie Fluke processes health information, an appropriate Article 6 lawful basis and Article 9 condition will be identified. Where required by law, additional safeguards under the Data Protection Act 2018 will also apply.
Access to health information will be restricted to persons who require access for the relevant service or lawful purpose.
13.5 Sharing information
Lizzie Fluke does not sell personal information.
Personal information may be disclosed where necessary to:

Where marketing is based on consent, consent may be withdrawn.
Withdrawal of marketing consent does not affect processing that is lawful on another basis.

Lizzie Fluke may photograph or record activities for educational, professional, documentary or promotional purposes.
Where identifiable images or video constitute personal data, they will be used in accordance with the applicable privacy information and lawful basis.
Where consent is required for a particular use, consent will be obtained separately.
A person may withdraw consent for future uses where the processing is based on consent. Withdrawal does not affect processing already lawfully carried out before withdrawal.

Lizzie Fluke will apply appropriate technical and organisational measures to protect personal data against unauthorised access, accidental loss, destruction, alteration or disclosure.
No website, online platform, email service or electronic transmission can be guaranteed to be completely secure.
Where a personal-data breach occurs, it will be assessed and managed in accordance with applicable legal requirements.

15. International Services
Lizzie Fluke provides services to clients and athletes across the UK, Saudi Arabia, MENA, Europe and other international locations.
Where services involve international clients, international service delivery, international payment providers, cloud platforms or the transfer of personal data between jurisdictions, applicable data-protection requirements will be considered.
Where UK and Saudi data-protection requirements both apply, Lizzie Fluke will comply with the applicable requirements of both regimes.
Where requirements differ, the processing will be assessed according to the applicable jurisdiction, purpose, data type and legal basis.
16. Third-Party Services and Platforms
The Lizzie Fluke website may use third-party platforms for payment processing, website hosting, membership management, communications, analytics, video, digital delivery and other services.
Third-party providers may process information on Lizzie Fluke's behalf or independently in accordance with their own terms and privacy notices.
Where Lizzie Fluke appoints a processor, appropriate contractual and data-protection requirements will apply where required.
